i know this was an issue on earlier versions of Big Sur as well but we are suddenly getting this on new enrollments of M1 11.6 machines, anyone else seeing this? Our PreStage is not setting a recovery lock password...

Check that you do not already created a same ID account using Jamf. If there exist a same ID account, you cannot create another account of the same ID. That could be the cause of your error.
