Am I over looking something? I have a static pilot group of about 30 computers. We have installed some software on a few of the machines and have decided to roll it out to the rest of the pilot group. I want to make a smart group based on only computers of the static pilot group who are still needing this application installed.

I don't believe you are missing anything. That functionality is missing as far as I know.

Is this still missing in version 8.62?

Would like to create a smart group based on static group.

Version 9 may have a way to do this. I imagine the nested groups feature, or whatever it will be called, will allow you to add a Static Group in as part of a Smart Group's criteria.
I don't really know for sure though, and even if I did, I couldn't mention it here! :)

I was just looking for similar capabilities in context of phased software deployments (https://jamfnation.jamfsoftware.com/discussion.html?id=7184): ie: static group A triggered on X day/time but only to groups matching dynamic smart groups Y. Until version 9, Mike I think your EA script pulling groups and allowing policies based on it may be the closest thing to a real solution: https://jamfnation.jamfsoftware.com/featureRequest.html?id=25
